Prosecuting Stalking Cases
Charging stalking is an effective tool for prosecutors to hold offenders accountable where they have engaged in a course of conduct putting the victim in fear for their safety and/or causing substantial emotional distress. This presentation will provide statutory analyses of Guam’s stalking and stalking-related statutes as well as discuss charging strategies to ensure that the reality of the victim’s experience is put before the fact finder. The presenter will also discuss the correlation between stalking and other forms of violence, combatting common defenses, the admission of digital evidence, and the importance of a collaborative approach to enhance victim safety and offender accountability.
The Intersection of Stalking and Human Trafficking
Human trafficking occurs when offenders identify, recruit, and exploit vulnerable individuals. In both labor and sex trafficking, offenders use a course of conduct, including force, fraud, and coercion to instill fear and inflict trauma on their victims. This presentation will explore the commonalities between stalking and human trafficking including tactics used by offenders to assert control, manipulate victims, and escape accountability. The presenter will provide strategies that investigators, prosecutors, and victim service professionals can employ to hold offenders accountable when they target and exploit vulnerable individuals.
